Assault vs. Battery
Assault and battery are often considered one in the same, but they are two separate charges. The difference is that assault charges do not require that actual physical contact is made.
Assault charges include allegations that there was an intentional action, or threat of an action, that caused a person to reasonably fear for their safety. Battery charges include actual physical violence causing bodily harm. In Georgia, the penalties for the misdemeanors of simple assault and simple battery are the same. However, family violence battery can have additional consequences – such as having to complete family violence intervention classes and losing your right to purchase firearms under federal law.
Penalties for assault and battery convictions include:
- Fines of up to $1,000
- Probation
- Potential restitution fines to victim
- Misdemeanor assault / battery punishable by up to 12 months in jail.
- Aggravated Assault / Aggravated Battery punishable by up to 20 years in prison.
It is important to understand that a simple assault charge can be increased to “aggravated” under certain scenarios. Aggravated assault includes the use of a deadly weapon or an object likely to cause serious injury, assaulting by strangulation, or assaulting with the intent to murder, rape, or rob someone. Aggravated Battery is causing substantial physical harm or visible bodily harm to another such as a permanent injury, disfigurement, or loss of use of a body part. If you are faced with allegations of aggravated assault and/or battery, it is essential to have an effective and experienced criminal defense attorney in your corner.
